Certilogo S.p.A. having its registered office in Milan (Italy), Via Leopardi, 1, Italy ("Certilogo", "we" or "us"), and contactable by email at privacy@certilogo.com, in its capacity as data controller, intends to provide users (the "Users" or "you") of brands.certilogo.com website ("Website") with information concerning the methods we use to collect and process your personal data on the Website, in accordance with Legislative Decree No. 196/2003 ("Privacy Code") and the European Privacy Regulation No. 679/2016 for personal data protection ("Privacy Regulation").

At Certilogo we are committed to protecting and respecting your privacy and personal data.

Certilogo has appointed Hubspot and SalesForce, among others, as data processors for services related to company marketing and sales. A complete list of the data processors we use may be requested to Certilogo at the email address privacy@certilogo.com, as per clause 7 of this Privacy Statement.

5. HOW DO WE PROCESS YOUR PERSONAL DATA?

Your personal data is processed by electronic and non-electronic means for the time strictly necessary to achieve the objectives for which that information has been collected.

We implement appropriate technical and organizational measures so as to prevent losses and illegal or incorrect use of data, or non-authorized access. We take reasonable steps to maintain the security of the personal data that we collect, including limiting the number of people who have physical access to our database servers, as well as installing electronic security systems that guard against unauthorized access.

Certilogo will ensure that such data transfer occurs in compliance with applicable laws and in particular with articles 45 and 46 of the Privacy Regulation.

7. WHAT ARE YOUR RIGHTS?

The User may, at any time and at no charge (a) obtain confirmation as to whether or not personal data concerning the User exist and receive communication of such data; (b) be informed of the source of the personal data, the purposes and methods of the processing, the logic applied to the processing, if the latter is carried out with the help of electronic means; (c) ask for updating, rectification or, where of interest, integration of the data; (d) request the cancellation, anonymization or blocking of data that have been processed unlawfully, as well as object to the processing on legitimate grounds, (e) object, wholly or partly, to the processing of data concerning the User for the purpose of direct marketing carried out through automated methods and/or traditional methods; (f) revoke the consent to the processing of the data at any time; this shall not compromise the legality of the processing in any way based on the consent given before its revocation.

8. WHAT IS GOING TO HAPPEN FROM MAY 25, 2018?

From 25 May 2018, the Privacy Regulation will become effective and the following provisions will apply:

A. Retention periods applying to your personal data

We will retain your data only for the period necessary to fulfill the purposes for which the data was collected as outlined in this Privacy Statement. In any case, the following retention periods will apply to the processing of your personal data for the purposes indicated below:

  • for the Mandatory Purposes, for the time of existence of the your account on the Website and the following 10 years;
  • for the Legitimate Interest Purposes under clause 2, letters e) and f), for the period necessary for the performance of the required activities and the following 10 years;
  • for the Legitimate Interest Purposes under clause 2, letter g), up to a period of 12 months from the collection of data or the consent to the performance of such activities, if occurred later;
  • for the Marketing Purposes of
    • clause 2, letter h), point i. up to a period of 24 months from the termination of the account;
    • clause 2, letter h), point ii. up to a period of 24 months from the collection of the data or the consent to the performance of such activities, if occurred later.

At the end of the retention period your personal data will be either cancelled, anonymized or aggregated.

B. Additional Rights

In addition to the rights as indicated in the clause 7 of this Privacy Statement when the  Privacy Regulation will become effective, you will have the right, in any given moment, to:

  1. request Certilogo to limit the processing of your personal data where:
    1. you contest the accuracy of the personal data until we have taken sufficient steps to correct or verify its accuracy;
    2. the processing is unlawful but you do not want us to erase your personal data;
    3. we no longer need your personal data for the purposes of the processing, but you require them for the establishment, exercise or defense of legal claims; or
    4. you have objected to processing justified on legitimate interests, pending verification as to whether Certilogo has compelling legitimate grounds to continue processing.
  2. object to the processing of your personal data;
  3. request the erasure of your personal data without undue delay;
  4. receive an electronic copy of your personal data, if you would like to port your personal data to yourself or a different provider, when we are relying upon your consent or the fact that the processing is necessary for the provision of the Product Authentication Service and the personal data is processed by automatic means; and
  5. lodge a complaint with the relevant data protection supervisory authority.

9. UPDATES TO THIS PRIVACY STATEMENT

Certilogo may modify or update this Privacy Statement, also following different interpretations, decisions, opinions and order relating to the Privacy Regulation.

Any changes to this Privacy Statement will be notified in advance and will in any case become effective when we publish the revised Privacy Statement on the Website.
